Terms of Service

These Terms of Service ("Terms") govern your access to and use of Velour (the "Service"). Velour is operated by Marcel Vanmoerbeke, an individual established in Belgium, reachable at marcel.vanmoerbeke@gmail.comand Leuven, Belgium ("we", "us", "our").

By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

Velour is intended only for adults. You must be at least 18 years old and legally capable of entering into a binding agreement to use the Service. By using Velour, you confirm you are 18+ and not offended by adult, sexual, or explicit fictional content.

You may not use the Service if doing so would violate applicable law, sanctions, platform rules, or third-party rights.

2. The Service

Velour is a private AI companion product that lets you create characters, start scenes, and exchange AI-generated messages. The Service may include adult, sexual, or otherwise explicit fictional content.

The Service is provided on an "as is" and "as available" basis. Features, limits, models, pricing, availability, and product design may change over time.

3. Accounts and Access

You are responsible for your account, the devices you use to access it, and activity performed through your account. Keep your login methods secure.

We may refuse, suspend, or terminate access where reasonably necessary to protect the Service, comply with law, prevent abuse, or investigate suspected violations of these Terms.

4. Acceptable Use

You agree not to use the Service to:

  • create, request, or distribute illegal content;
  • sexualize minors or generate exploitative sexual content involving minors;
  • harass, stalk, threaten, extort, defame, or impersonate a real person;
  • promote violence, terrorism, malware, fraud, or unlawful schemes;
  • interfere with the Service, scrape it at scale, probe for vulnerabilities, or bypass limits;
  • use the Service in a way that infringes intellectual property, privacy, or publicity rights.

We may remove content, restrict access, or cooperate with competent authorities where we reasonably believe this is necessary to enforce these Terms, protect users, or comply with law.

4a. Your Representations and Warranties

You represent and warrant that:

  • All information you provide to us is accurate, current, and not misleading;
  • You have all rights needed to submit User Content and it does not violate any law or third-party rights;
  • You will use the Service lawfully and in good faith;
  • You will keep your login credentials secure and not share them with third parties;
  • You are 18+ and not prohibited from using the Service under applicable law.

5. AI Output Disclaimer

AI-generated content may be inaccurate, offensive, incomplete, inconsistent, or unsuitable for your purposes. It is generated automatically and should not be relied on as medical, legal, therapeutic, financial, or professional advice.

You are responsible for how you use, interpret, share, or act on outputs. We do not guarantee any particular output, emotional outcome, compatibility, or uninterrupted availability.

5a. Third-Party Links and Services

The Service may contain links to third-party websites, services, or resources. We do not control or endorse these and are not responsible for their content, privacy practices, or availability.

You agree that we are not liable for any loss or damage arising from your use of third-party services, including advertising, payments, or transactions with third parties.

6. Your Content

You retain your rights in prompts, profile text, characters, and other content you submit ("User Content"). You grant us a limited, non-exclusive, revocable license to host, process, encrypt, store, transmit, and otherwise use User Content as needed to operate, secure, maintain, and improve the Service for you.

You represent that you have the rights needed to submit User Content and that doing so does not violate law or third-party rights.

7. Paid Features, Billing, and Cancellation

Some features require a paid subscription. Prices, billing intervals, and tax treatment are shown at checkout. Payments are processed by Stripe or its affiliated payment tools, not directly by us.

Unless stated otherwise at checkout, subscriptions renew automatically until canceled. You may cancel through the payment management tools made available by Stripe, where available, or by contacting us. Cancellation normally takes effect at the end of the current billing period unless mandatory law requires otherwise.

Fees already paid are non-refundable except where refund or withdrawal rights are required by applicable law. If mandatory consumer law gives you rights that cannot be waived, those rights prevail.

8. Intellectual Property

The Service, including its software, interface, branding, and non-user content, is owned by us or our licensors and protected by intellectual property laws. Except as expressly allowed, you may not copy, resell, sublicense, reverse engineer, or create derivative works from the Service itself.

9. Availability and Changes

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, temporarily or permanently, with or without notice. We are not obligated to support or update the Service. Any new features that augment or enhance the current Service will be subject to these Terms.

We do not promise that the Service will always be available, error-free, or compatible with every device, region, browser, or third-party service.

10. Suspension and Termination

You may stop using the Service at any time. We may suspend or terminate access immediately if you materially breach these Terms, create risk for the Service or others, fail to pay applicable fees, or where continued access would expose us to legal or security risk.

Clauses that by their nature should survive termination do survive, including those on billing, intellectual property, disclaimers, liability, and dispute resolution.

10a. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from causes beyond our reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, pandemics, infrastructure failures, or telecommunications breakdowns.

10b. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any and all claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:

  • Your use of or access to the Service;
  • Your breach of these Terms;
  • Your violation of any third-party rights;
  • Any User Content you submit that infringes or misappropriates third-party rights;
  • Your conduct in connection with the Service.

11. Warranties Disclaimer

To the fullest extent permitted by applicable law, the Service is provided without warranties of any kind, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and quiet enjoyment.

12. Limitation of Liability

To the fullest extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, goodwill, data, business, or opportunities arising out of or related to the Service.

To the fullest extent permitted by applicable law, our aggregate liability arising out of or relating to the Service will not exceed the greater of (a) the total amount you paid us for the Service in the 12 months before the event giving rise to the claim, or (b) EUR 250.

Nothing in these Terms excludes or limits liability where exclusion is not permitted under applicable law, including for fraud, wilful misconduct, gross negligence where non-excludable, death or personal injury caused by negligence where non-excludable, or mandatory consumer rights.

13. Consumer Rights

If you are a consumer residing in Belgium, the EEA, the United Kingdom, or Switzerland, nothing in these Terms limits rights you cannot waive under mandatory consumer law.

If you have a complaint, please contact us first at marcel.vanmoerbeke@gmail.comso we can try to resolve it informally. Consumers in Belgium may also seek assistance from the Consumer Mediation Service (Service de Mediation pour le Consommateur / Consumentenombudsdienst), without prejudice to any rights they may have before competent authorities or courts.

13a. Dispute Resolution — Individual Only

Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively on an individual basis. You waive any right to participate in class actions, collective actions, or representative proceedings.

This means you cannot join or be part of a class action, group action, or any consolidated or representative claim against us. All claims must be brought in your personal capacity, not as a plaintiff or class member.

14. Governing Law and Disputes

These Terms are governed by Belgian law, excluding conflict-of-law rules, except to the extent mandatory consumer law in your country of residence applies and cannot be displaced.

Before starting formal proceedings, you and we agree to try in good faith to resolve the dispute informally for at least 30 days after written notice.

If you are not a consumer, the courts of Brussels, Belgium have exclusive jurisdiction over disputes arising out of or related to these Terms or the Service.

Any claims relating to use of the Service must be brought within one (1) year from the date the cause of action arose. Claims brought after this period are void.

15. Changes to These Terms

We may update these Terms from time to time. The updated version becomes effective when posted, unless a later date is stated. Your continued use of the Service after the effective date means you accept the updated Terms.

15a. Export Control

You agree to comply with all applicable laws regarding software and the transmission of technical data, including export control laws of Belgium, the EU, and the United States. You represent that you are not located in a country subject to export restrictions and will not transfer data to restricted jurisdictions.
